Trading Account Asset Custody Agreement

EXINONE CO., LIMITED (hereinafter referred to as "ExinOne" or "the Company"), a company registered and established under the laws of the Republic of Seychelles, hereby enters into this Trading Account Asset Custody Agreement (hereinafter referred to as "this Agreement") with registered users (hereinafter referred to as "You" or "User") concerning the management of trading account assets. By using the trading account services provided by ExinOne, users indicate that they have fully understood and agreed to accept the terms of this Agreement and the rules, page prompts, operation procedures, announcements, and notices that ExinOne may publish or update from time to time.

Users are advised to carefully read the entire content of this Agreement before accepting it, especially the disclaimers and limitation of liability clauses. If there are any questions, legal advice should be sought. If you do not accept any terms of this Agreement, or need help to understand ExinOne's interpretation of the terms accurately, please stop using ExinOne's services.

Applicable Conditions Eligibility Requirements: You confirm that, when registering as an ExinOne user and using its services, you must be a natural person, legal person, or other organization with full capacity for civil conduct and civil rights. If not, you and your guardian shall bear all consequences arising therefrom, and ExinOne reserves the right to cancel or permanently freeze your account and to seek compensation from you and your guardian.

Prohibited Conditions You confirm that, when using ExinOne and its services, you are not on any trade or economic sanctions list, such as United Nations Security Council sanctions. ExinOne has the right, according to its policies and legal requirements, to restrict or refuse to provide services to specific countries or regions. The content of this Agreement shall not violate the laws of the country or region where the user is located. ExinOne will prohibit individuals or entities on the sanctions list from using its services. ExinOne prohibits any person in Belarus, Congo, Iraq, Iran, North Korea, Syria, Sudan, South Sudan, Zimbabwe, Cuba, Crimea, Malaysia, Ontario, Canada, the United States, and its territories (including American Samoa, Guam, Northern Mariana Islands, Puerto Rico, U.S. Virgin Islands) from using the services provided by this product.

Definitions

Trading Account: A fund custody account opened by users on ExinOne for depositing, trading digital assets, and obtaining asset dividends. EPC: ExinOne's platform commission point card, used for transaction fee deductions. Asset Dividends: Numerical values calculated based on the storage amount of user assets and other factors, used for ExinOne's lending services.

Asset Custody

  • Custody Subject: Digital assets deposited by users into the trading account. Custody Duration: From the effective date of the agreement until the assets are completely withdrawn or the account is retired.
  • Custody Fee: The service is provided free of charge.
  • Custody Interest: The trading account is not a financial product and does not generate interest.
  • Custody Method: Only tokens credited to the trading account (OP, SEI, ORDI, ENS, etc.) are stored in the exchange, and freely transferable tokens (BTC, ETH, BOX, MOB, EOS, etc.) are stored within the Mixin Network. Some assets may be kept using Mixin's multi-signature scheme. ExinOne ensures that there are sufficient assets within Mixin Network and the exchange for ExinOne, but does not guarantee the security of Mixin Network or the exchange.

User Rights and Obligations

Users shall ensure the legality of asset sources and comply with relevant laws and regulations. Users acknowledge market risks, and ExinOne does not assume responsibility for losses caused by value fluctuations. Users understand that specific assets may only support trading and not support transfer operations to Mixin wallets, etc. Users clearly understand that assets in the trading account exist within Mixin Network or the exchange. If any issues with Mixin Network or the exchange result in asset loss, ExinOne does not bear corresponding responsibility.

Force Majeure

ExinOne is not liable for service interruptions or asset losses caused by force majeure, including but not limited to system maintenance, third-party service failures, third-party platform asset damage, natural disasters, etc. ExinOne will take reasonable measures to restore service as soon as possible.

Termination and Dissolution

ExinOne reserves the right to suspend or terminate user accounts in cases of violation of terms, laws, regulations, or other reasonable suspicions, and retains the relevant data.

Law Applicability and Dispute Resolution The laws of the Republic of Seychelles govern this Agreement. Any dispute shall first be resolved through negotiation. If negotiation fails, it shall be submitted to the courts of the Republic of Seychelles for resolution.

Final Interpretation Right

ExinOne reserves the right of final interpretation of this Agreement and has the right to modify the terms of this Agreement according to changes in laws, regulations, or business needs. Newly established and modified rules will be published on this page without individual notification, and will take effect immediately upon publication.
